Public Hearing for Consideration of Adopting Proposed New Policy 5.7.1, Student Enrollment and Educational Decisions - p.21

Executive Summary

During the last session of the Legislature, Florida’s divorce laws were drastically changed effective October 1, 2008.  The law now favors the concept of 50/50 “time share” (custody) between the parents.  The 50/50 “time share” can take many forms and for this reason, the proposed rule will provide guidance for schools and parents on how disputes between parents will be resolved and what are the parent’s rights.

 

At the June 8, 2009 School Board meeting, Rule 5.7.1 was withdrawn by the Superintendent to address possible concerns from law enforcement and Board members.  Additional changes have been made in the proposed rule and are indicated in blue.   Revisions made prior to the June 8, 2009 Board meeting are in red. 

 

On June 22, 2009, the Board approved advertising the proposed new Policy 5.7.1, and setting a public hearing.  On June 25, 2009, the advertisement appeared in The Bradenton Herald, which assures compliance with the provision of section 120.54 (3)(a)1, Florida Statutes (2008). In addition, the policy has been posted on the district website.

 

The Superintendent recommends approval of adopting proposed new Policy 5.7.1, Student Enrollment and Educational Decisions.
